PLEASE READ CAREFULLY BEFORE SIGNING

This is a release of liability and a waiver of certain legal rights.

This Agreement must be signed by all clients of FOCUS CAMP1, LLC (collectively referred to herein with FOCUS CAMP1’s employees, owners, officers, directors, agents, independent contractors and assigns as “FOCUS CAMP1”). If the client is a minor, it must be signed by the minor's parent or legal (court-appointed) guardian, who signs for themselves and, if allowed by law, the minor visitor. “Visitor” as used in this Agreement includes participants in FOCUS CAMP1 Activities (see below) and other persons that enter a FOCUS CAMP1 facility or take part in a FOCUS CAMP1 activity.

In consideration of the services of FOCUS CAMP1, I, an adult client visitor or parent/legal guardian of a visitor who is a minor, acknowledge and agree as follows:

ACTIVITIES

This Agreement applies to facilities operated by FOCUS CAMP1, other facilities that FOCUS CAMP1 uses for its activities, and any outdoor or remote locations where FOCUS CAMP1 is conducting activities. Activities of FOCUS CAMP1 (“FOCUS CAMP1 Activities”) include but are not limited to:

• The use of roped (toprope, auto-belay, and lead climbing) climbing walls, bouldering areas, weights, and other training and fitness equipment.
• Participation in activities or events including gear demonstrations, parties, clinics, training, yoga, and other fitness classes.
• Remote outdoor climbing, camps, and classes.
• Travel to other activity sites.
• Use of parking areas.
• The rental, borrowing, or purchasing of equipment from FOCUS CAMP1.
• Other activities and use of facilities and equipment at a FOCUS CAMP1 gym or elsewhere.

RISKS

I recognize and understand that there are risks, hazards, and dangers in FOCUS CAMP1 Activities, inherent and otherwise, and that participation could result in injuries of all kinds, including serious injury or death. The risks involved include, but are not limited to:

• Hazards in traveling to the location of an activity, parking, and moving about areas in the vicinity of the gym or other activity site.
• Falling, collisions with objects, people, or structures; uneven, worn, or hard landing surfaces.
• Being struck by other visitors, clients, or objects.
• Loose, broken, or falling handholds or rocks; equipment failure even if properly used.
• The conduct, including negligent conduct, of other visitors, participants, staff, volunteers, and third parties.
• Exposure to weather, plants, wildlife, pathogens, or communicable diseases.
• Aggravation of pre-existing conditions.
• Risks identified by FOCUS CAMP1 through rules and warnings, whether written, oral, or otherwise.
• Other foreseeable or unforeseeable risks.

I accept that these and other risks are inherent in a visit to a FOCUS CAMP1 facility or activity site. Participation is voluntary, and visitors may withdraw at any time.

ASSUMPTION OF RISKS

Understanding these risks, I expressly accept and assume all risks associated with FOCUS CAMP1 Activities, whether caused by negligent acts or otherwise. Participation is purely voluntary. If the visitor is a minor, I have explained the activities and risks to them, and the minor wishes to participate nevertheless.

WAIVER, RELEASE OF LIABILITY, AND INDEMNITY

I, an adult visitor, or parent/guardian of a minor (for myself and on behalf of the minor), agree not to sue, and to release, discharge, indemnify, and hold harmless FOCUS CAMP1 and all related parties, for any damages, claims, liability, or causes of action arising from participation in FOCUS CAMP1 Activities, use of facilities, or equipment.

OTHER TERMS

1. I, or the minor visitor, am capable of participating and have no condition that would cause danger to ourselves or others. I warrant I have adequate insurance or financial means to cover injuries or damages.
2. I am responsible for assessing the quality of my, or the minor visitor’s, gear, and FOCUS CAMP1 is not liable for lost or stolen items.
3. To participate, I, or the minor, must sign this agreement, complete required instructional programs, and follow all rules, warnings, and regulations.
4. I, or the minor, agree to a code of conduct: treat others with courtesy, share equipment responsibly, respect personal boundaries, follow staff instructions, and refrain from inappropriate behavior.
5. Guidelines, reviews, and training do not certify capability; visitors are responsible for their own safety.
6. In the event of an accident, I authorize FOCUS CAMP1 to provide medical care and agree to cover associated costs.
7. FOCUS CAMP1 may take photos or videos for marketing and promotional purposes.
8. The prevailing party in any dispute will be awarded reasonable attorney fees and costs.
9. This Agreement is the entire agreement and remains in force in perpetuity for all FOCUS CAMP1 Activities.
10. If any provision is invalid, it will be modified to the minimum extent necessary, without affecting the rest of the Agreement.
11. This Agreement is governed by the laws of California and disputes will be resolved by arbitration in San Francisco, CA, administered by JAMS.

I HAVE CAREFULLY READ, UNDERSTAND, AND VOLUNTARILY SIGN THIS ACKNOWLEDGMENT AND ASSUMPTION OF RISKS, RELEASE OF LIABILITY, AND INDEMNITY AGREEMENT. I intend for it to apply to the fullest extent allowed by law and be binding upon members of my, or the minor child’s, family, parents, heirs, assigns, and administrators.
